Macleod served over two years, while awaiting sentencing

Nathan Macleod, found guilty after breaking into a home at Somerset Farm and lighting it on fire, has been released from jail, having served his jail time while awaiting sentencing.

On October 7, 2023, Macleod broke into the home of Eric and Sue Boulton at Somerset Farm.

On entering the home, he found Sue in the living room, and refused to leave when asked to. Carrying an axe, Macleod had disabled the phone to prevent the Boultons from calling 911. He went upstairs, and set fire the home.

Sue and Eric left the house, and were able to call for help. The Gabriola Volunteer Fire Department, Gabriola RCMP, and BC Ambulance attended the scene.

Macleod was taken into custody, and remained in custody for the entire time he was being charged, and on trial, until sentencing.

According to court documents, he was sentenced on June 13, and released on probation for having already served that time.

According to staff, the Crown and the defence made a joint sentencing submission, and the court imposed the sentence sought by the Crown and the defence.

On the charge of arson, Macleod was sentenced to 927 days of jail (2 years and 7 months). The court credited the accused at what is considered a rate of 1.5 for the 618 days he spent in pre-sentence custody – meaning the accused has already served his jail sentence

On the charge of arson, Macleod will be on probation for two years, and has a mandatory lifetime firearms prohibition.

On the charge of mischief, the court sentenced Macleod to 180 days of jail. The court credited the accused for the time he spent in pre-sentence custody. Macleod will be on probation for the mischief charge for two years, and will be required to pay a $5,000 restitution order.

In 2020, Macleod pled guilty to arson, after lighting a fire at Emily Carr University on Oct. 5, 2020.
